TIME FOR A BUYER’S AGENT

It is the start of 2008 and the interest rates are still great (under 6%). The inventory is up-way up.

What does this mean to you? It is the best time to be a buyer in years. The Daytona Beach area has had tremendous value as compared to other areas along the Atlantic Ocean. The prices are back to what they were in 2004 and 2005. You have many choices, and in some situations very motivated sellers.

You might consider working with a BUYER’S AGENT.

What does that mean? A little over ten years ago the real estate industry went through a complete makeover in how the industry deals with buyers and sellers. Up until the early 90’s the ethics and guidelines said that all agents worked for the seller. That is correct. Since the seller paid the commission everyone was trying to get the highest and best price for the seller. Not necessarily the best "buy" for the buyer. The problem was; there was much confusion. Sellers thought the agent who brought the buyer worked for the buyer. The buyer thought their agent worked for them and many of the agents were not sure either.

The good news is that has changed. The term is "AGENCY." Each state developed their own criteria on how this would all play out. With terms like: buyer’s agent, dual agent, single agent, seller’s agent, designated agent, sub agent and non represented buyer agent. Well, Florida took a little bit different approach: Transaction Brokerage. This is a good thing. You probably have been asked to sign a form at some part of any previous transaction or listing to help explain what transaction brokerage means. The idea is to make sure you have a clear understanding on the home buying and selling process.

In Florida it is Transaction Brokerage: Florida Law requires that real estate licensees operation as transaction brokers disclose to buyers and sellers their role and duties including the following:

  1. Dealing honestly and fairly;
  2. Accounting for all funds;
  3. Using skill and diligence in the transaction
  4. Disclosing all known facts that materially affect the value of residential real property and are not readily observable to the buyer;
  5. Presenting all offers and counteroffers.
